Now that a jury has acquitted a defendant charged with murdering a police officer whose 2007 death prosecutors tried to link to bullets the defendant shot into the officer more than 40 years earlier, many attorneys are questioning why the Philadelphia district attorney’s office proceeded to trial despite the lengthy time gap between the shooting and the officer’s death and despite the defendant’s prior attempted murder conviction in the shooting.

At an examining trial this month, a Texas magistrate judge found there is enough probable cause to forward to a grand jury a murder charge against Dallas plaintiffs lawyer Scott Marshall. Police are still investigating why Marshall allegedly shot Staci Montgomery — the ex-wife of Bady Sassin, Marshall’s former law partner. However, the civil litigation concerning the breakup of Sassin and Marshall’s firm — including a hearing just days before the shooting — provides some background to the murder charge.
