A federal judge has ordered the losing plaintiff in a patent infringement case to pay the two defendants a total of $6.5 million in attorney fees and costs.

Intellectual Ventures has filed a patent infringement suit against Google’s $12.5 billion acquisition, Motorola Mobility, over Motorola’s Android-based phones. The suit creates a potentially embarrassing scenario for Google, which has invested in IV.

Nonpracticing entities are rushing to file multidefendant patent infringement suits before President Obama signs patent reform legislation into law, and many of their targets are Silicon Valley companies. Not surprisingly, plaintiffs are filing most of the suits in the Eastern District of Texas.

Despite failing to get its patent infringement case moved from the plaintiff-friendly Eastern District of Texas and a court order applying a rare infringement theory, Vistaprint’s defense team scored a defense victory in the district.

Out of 10 defendants in a patent infringement case brought by Spanish antenna company Fractus, only Samsung stuck it out to face the jury. The go-it-alone strategy failed, and the verdict could cost Samsung close to $80 million in treble damages.
