An Oregon federal district court judge has vacated an $85 million jury verdict for Smith & Nephew against rival medical device company Arthrex, handing Arthrex’s lawyers at Dickstein Shapiro another victory in their long-running patent fight with Fish & Richardson.

9th Circuit Strikes Down Law on Providing Explicit Materials to Minors

It shouldn’t be illegal to sell a Judy Blume novel to a little girl, the 9th Circuit said Monday. A three-judge panel found a pair of Oregon statutes that ban certain people from providing minors with sexually explicit information unconstitutionally broad, reversing a district court judgment. The ruling sides with booksellers and others, including a grandmother, who sued to halt enforcement of the laws, which are aimed at preventing child abuse.

Google Sued for Scooping Up Wi-Fi Data

Three Oregon lawyers have filed what is believed to be the first class action against Google’s so-called data sniffing — the company’s now-ended practice of scooping up bits of private wireless data with its Street View vehicles. The complaint, filed this week in federal court in Oregon, alleges that the company violated Washington and Oregon privacy laws as well as the federal Electronic Communications Privacy Act. The plaintiffs are seeking up to $10,000 per violation suffered by each class member plus other damages.

Les Schwab Tire Centers to Pay $2M Because Women Can Change a Tire

The U.S. Equal Employment Opportunity Commission announced Thursday that Les Schwab Tire Centers, based in Seattle, has agreed to pay $2 million to resolve claims that it failed to hire qualified women for tire-changing jobs at its stores in Washington, Oregon, California, Idaho, Montana, Nevada and Utah.

Texas Bar Considers Insurance Disclosure Rule for Lawyers

The State Bar of Texas last week concluded a series of seven public hearings focusing on whether lawyers should have to disclose if they have professional-liability insurance. A majority of the 67 speakers who testified at the hearings were of a like mind: They oppose such a rule. According to the American Bar Association, Oregon is the only state where professional-liability insurance is mandatory for lawyers, and there are 25 other states with rules requiring lawyers to disclose whether or not they have such coverage.
