Jury Says Philadelphia’s Eviction of Boy Scouts Violates First Amendment

A federal jury on Wednesday declared that the city of Philadelphia had violated the First Amendment rights of the local chapter of the Boy Scouts of America by moving to evict it from its city-owned headquarters if it refused to repudiate the anti-gay policies of the Scouts’ national parent group. However, the jury rejected the Scouts’ claim that the city had engaged in “viewpoint” discrimination and also rejected an Equal Protection claim by finding that the city had a rational basis for its actions.

Bank of America to Pay Borrowers $108 Million in Countrywide Case

Bank of America will pay $108 million to settle federal charges that Countrywide Financial Corp., which it acquired nearly two years ago, collected outsized fees from borrowers facing foreclosure. The settlement, which seeks to refund money to about 200,000 borrowers, was announced today by the Federal Trade Commission. It is the largest mortgage industry settlement for the agency, which has been criticized for failing to protect consumers from abuse by financial companies.

Prominent Yale Donor and Former Outside Counsel Charged in $60 Million Fraud

The New York County district attorney’s office has charged James Mazzuto, a former CEO of Industrial Enterprises of America, and James Margulies, an outside lawyer, with running a $60 million stock scheme. Margulies, a founding partner of Cleveland-based Margulies & Levinson, served as outside counsel to Industrial Enterprises and briefly was its top executive in 2008. He also served on the company’s board of directors and worked as its CFO and general counsel.
